UZ plans to approve a list of exceptional conditions under which it will not charge a fee for the use of wagons

 

The board of JSC "Ukrzaliznytsia" is considering a draft decision on establishing a list of special conditions that give the company the right not to charge payments for the use of wagons, the deputy director of the department of commercial work of UZ Valery Tkachev said.

The carrier's representative answered a question about railway logistics.

"Currently, there is a problem with the loading of grain at grain-receiving enterprises located in small towns and villages, and where electricity is available for several hours a day, or there is no electricity at all. Station employees refuse to draw up acts of delay of wagons due to the lack of electricity, several wagons are idle days and more. How do you plan to get out of similar situations in the future, given that all these cases fall under force majeure? Is it legal to charge senders for simple money in conditions of war and power outages?", asked one of the group members .

Tkachev noted that at the moment UZ does not have an effective mechanism not to charge a fee for the use of wagons under the specified conditions.

"Therefore, record the specified circumstances (acts, certificates of the State Register of Trade and Industry, TPP) and protest the accrual in a claim/court procedure," replied the deputy director of the department of commercial work of the UZ. - Currently, the draft of the board's decision on establishing a list of exceptional conditions that grant the right to the UZ is in the process of approval not to charge specified payments, etc. If this decision is adopted, we will get a mechanism not to charge individual payments in the presence of exceptional conditions (curfew, blocking, military operations, etc.)."
